After years of speculations of tech giant Apple slowing down their older model phones, consequences may soon follow.

Apple, alongside Samsung, is being sued by Italian authorities for five million euros, approximately $5,697,130 in American dollars, for “unfair commercial practices.” Apple is being hit with an additional 5 million euro fine for not also providing customers with information on how to maintain and replace iPhone batteries, prompting consumers to purchase new devices.

Italy’s statement reads both company’s software updates “had caused serious dysfunctions and reduced performance significantly, thereby accelerating the process of replacing them.”

According to BBC, Samsung said it was “disappointed” with the lawsuit and plans to appeal:

“Samsung did not issue any software update that reduced the Galaxy Note 4’s performance… In contrast, Samsung has always released software updates enabling our customers to have the best experience possible.”

Last year, Apple admitted it throttled the performance of older phones in order to expand the longevity of the phone over time and to assist with its battery life.
