Republican and Senate Majority Leader Mitch McConnell promised on Fox News that he would be taking cues directly from the White House when dealing with the impeachment proceedings, rather than remain impartial as the Constitution demands. The senator has also rejected Chuck Schumer's calls for testimony from several key witnesses, including former national security adviser John Bolton and acting White House chief of staff Mick Mulvaney. "It is not just that it violates the Constitution, it violates the oath they swear," says Dahlia Lithwick, senior editor and legal correspondent at Slate. "This is a specific oath they swear as it relates to impeachment — that they will be impartial jurors." Mark Green, who co-authored the book "Fake President" with Ralph Nader, adds that rather than speaking truth to power, "Trump and McConnell and all of them are power to truth."

Supreme Court justice nominee Brett Kavanaugh is facing accusations of perjury following his confirmation hearing last week. Democratic Senator Patrick Leahy of Vermont has suggested Kavanaugh lied to the Senate Judiciary Committee during his 2004 and 2006 hearings to become a federal judge. During those hearings Kavanaugh denied seeing private Democratic files that detailed strategies for opposing Republican judicial nominees while he was associate counsel in the George W. Bush White House. We speak with Lisa Graves, former top aide to Senator Patrick Leahy, whose new piece for Slate is: “I Wrote Some of the Stolen Memos That Brett Kavanaugh Lied to the Senate About.” Graves is the former chief counsel for nominations for the ranking member of the Senate Judiciary Committee and was deputy assistant attorney general in the Department of Justice. She is now co-director of Documented, which investigates corporate influence on democracy.

The New York Times is reporting Trump personally asked FBI Director James Comey to end the agency’s investigation into Trump’s former national security adviser, Michael Flynn. The New York Times reports President Trump made the extraordinary request to James Comey during an Oval Office meeting on February 14—one day after Trump fired Flynn for lying both publicly and privately about his contacts with Russian officials. Trump reportedly asked Vice President Mike Pence and Attorney General Jeff Sessions to leave the room before making the request to Comey. After the meeting, Comey wrote a memo quoting the president saying, "I hope you can see your way clear to letting this go, to letting Flynn go. He is a good guy. I hope you can let this go." We speak to John Kiriakou, who spent 14 years at the CIA as an analyst and case officer. He was jailed for 23 months after he became the first CIA official to confirm publicly the Bush administration’s use of waterboarding.
