Supreme Court Strikes Down Affirmative Action in Colleges But Keeps It for Military Academies

The conservative majority of the U.S. Supreme Court has declared race-conscious admissions policies at colleges and universities across the country to be unlawful, effectively ending affirmative action in education. The landmark 6-3 ruling was along ideological lines and strikes down decades of precedent, but stops short of banning legacy admissions and allows military academies to continue using affirmative action. Justice Ketanji Brown Jackson, the first Black woman to serve on the court, assailed the majority's "let-them-eat-cake obliviousness" to questions of racism and equity. We host a roundtable discussion on the ruling and its impact with Wisdom Cole, national director of the NAACP Youth and College Division; Janelle Wong, director of Asian American studies and a professor of American studies and government and politics at the University of Maryland; and Pulitzer Prize-winning journalist Maria Hinojosa, founder of Futuro Media and host of the Latino USA podcast.

Radical Supreme Court Guts State Gun Laws & Right to Remain Silent Under Arrest

The U.S. Supreme Court on Thursday struck down a century-old New York state law that limited who can carry concealed weapons in public, with Justice Clarence Thomas writing for the 6-3 majority that the statute violated the Second Amendment's right to bear arms. The ruling vastly expands gun rights in the U.S. just weeks after mass shootings in Buffalo, New York, and Uvalde, Texas, and represents "a revolution in Second Amendment law," says Slate senior writer Mark Joseph Stern. "It declares that any restriction on the right to self-defense is presumptively unconstitutional." In light of the Supreme Court decision, a bipartisan gun violence bill passed by the Senate is "one step forward, two steps back." Stern also discusses a separate ruling in which the court's conservative majority said a person who is arrested and not told of their right to remain silent cannot subsequently sue police for violating their Fifth Amendment rights against self-incrimination — even if statements they give are ultimately used against them at trial. The decision could be setting the stage for the court to overturn the 1966 Miranda v. Arizona precedent altogether, Stern warns.

President Trump has nominated federal Judge Brett Kavanaugh to fill Anthony Kennedy’s seat on the high court. Kavanaugh has deep ties to the Republican Party and will push the Supreme Court further right if he is confirmed. Kavanaugh served as a senior aide under President George W. Bush in the White House Counsel’s Office. He has similar credentials to Supreme Court Justice Neil Gorsuch. Both clerked for Anthony Kennedy, and both are backed by the Federalist Society and Heritage Foundation, who drew up a list for Trump in 2016 of suitable right-wing judges to consider for the Supreme Court.
